1. Acceptance of Terms

By using FaxSmile ("the Service"), you agree to these Terms of Service. If you do not agree, do not use the Service.

2. Description of Service

FaxSmile provides an online fax transmission service that allows users to send fax documents to US fax numbers. The Service is provided on a per-transaction basis with no account or subscription required.

3. Acceptable Use

You agree to use the Service only for lawful purposes. You may not use FaxSmile to:

  • Send unsolicited bulk faxes (fax spam)
  • Transmit harassing, threatening, or illegal content
  • Infringe on the intellectual property rights of others
  • Attempt to circumvent or test the security of the Service
  • Send content that violates any applicable law or regulation

We reserve the right to suspend access to the Service for violations of these terms.

4. Payment Terms

Fax transmission is charged at the rates published on our Pricing page. By submitting a fax, you authorize FaxSmile to charge your payment method upon successful delivery.

If fax delivery fails after all retries, the payment authorization is voided and you will not be charged. You agree to Stripe's terms of service in connection with payment processing.

All fees are non-refundable once a fax has been successfully delivered.

5. Delivery

FaxSmile will attempt to deliver your fax to the number provided. We do not guarantee delivery to all fax numbers. Delivery failures may occur due to:

  • The recipient number not being a valid fax line
  • The recipient's fax machine being unavailable, busy, or out of paper
  • Poor line quality or carrier-level issues beyond our control

We are not liable for damages resulting from fax delivery failure or delay.

6. Content Responsibility

You are solely responsible for the content of documents you transmit. FaxSmile does not review the content of uploaded files except as necessary for page counting and fraud detection. By uploading a document, you represent that you have the legal right to transmit that content.

7. Limitation of Liability

To the maximum extent permitted by law, FaxSmile and its operators shall not be liable for any indirect, incidental, special, or consequential damages arising out of your use of the Service. Our total liability for any claim arising from these terms or your use of the Service shall not exceed the amount you paid for the specific transaction giving rise to the claim.

8. Disclaimer of Warranties

The Service is provided "as is" without warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not warrant that the Service will be uninterrupted or error-free.

9. Changes to Terms

We may update these terms from time to time. Continued use of the Service after changes are posted constitutes acceptance of the updated terms. The date at the top of this page reflects the most recent revision.

10. Governing Law

These terms are governed by the laws of the United States. Any disputes shall be resolved in accordance with applicable US law.
